Terms of Service

Please read these Terms of Service ("Terms") carefully before using the RecruiterView platform operated by RecruiterView ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

RecruiterView provides a web-based recruiting operations platform (the "Service") for use by recruitment agencies and staffing firms. The Service includes candidate pipeline management, SLA tracking, workflow configuration, recruiter performance reporting, and related features as described at getrecruiterview.com.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

2. Accounts and access

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@getrecruiterview.com if you suspect any unauthorised access.

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organisation. By creating an account on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent, abusive, or illegal activity.

3. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Upload or transmit malicious code, viruses, or any software intended to damage or disrupt the Service
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Scrape, crawl, or systematically extract data from the Service without our written permission
  • Use the Service to process personal data in ways that violate applicable data protection laws
  • Resell, sublicence, or provide access to the Service to third parties in a way not expressly permitted by your subscription plan

4. Your data

You retain ownership of all data you submit to the Service, including candidate records, documents, and any other content ("Customer Data"). By submitting Customer Data, you grant us a limited, non-exclusive licence to store, process, and transmit that data solely for the purpose of providing the Service to you.

You are solely responsible for ensuring that your collection and use of candidate and personal data through the Service complies with all applicable data protection and privacy laws, including GDPR where applicable. You represent that you have obtained all necessary consents and have a lawful basis for processing any personal data you input into the Service.

We process Customer Data only as described in our Privacy Policy. We do not sell Customer Data or use it for any purpose other than operating the Service.

5. Subscription and payment

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or required by law.

We may change our pricing at any time with 30 days' notice. Your continued use of the paid Service after a pricing change constitutes acceptance of the new pricing.

If payment fails, we may suspend access to paid features after a reasonable grace period. We will notify you before suspension. Accounts suspended for non-payment for more than 60 days may be terminated and data deleted with 14 days' advance notice.

6. Intellectual property

The Service, including its software, design, features, and documentation, is owned by RecruiterView and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, sell, or create derivative works of the Service or any part thereof without our written permission.

You retain all intellectual property rights in your Customer Data. Nothing in these Terms transfers any ownership of Customer Data to us.

7. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Service that is designated as confidential or that reasonably should be understood to be confidential given its nature. This obligation does not apply to information that is or becomes publicly known through no breach of these Terms, or that is independently developed without use of confidential information.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. We make no warranty regarding the accuracy or reliability of any results obtained through the Service.

9. Limitation of liability

To the fullest extent permitted by applicable law, RecruiterView shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless RecruiterView and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.

11. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your access to the Service at any time for breach of these Terms, with or without notice.

Upon termination, your right to access the Service ceases immediately. We will retain your Customer Data for 90 days following termination to allow you to request an export, after which it will be deleted. This does not apply where we are required to retain data for legal or compliance purposes.

12. Governing law and disputes

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before bringing any formal legal claim, both parties agree to attempt to resolve disputes in good faith through direct negotiation for at least 30 days.

13. Changes to these Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the Service. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
